Understanding the Auto Insurance State Laws

The tort state. Tort defines the injuries that are eligible to receive compensation or payment under the law. In a tort state, one will be identified as the responsible person who caused the accident. Even the tort state can further be categorized as ‘full tort’ and ‘limited tort’ where in the limited tort state would only allow sufferers to claim until and unless they are permanently disabled.

The no-fault state. The no-fault state requires the drivers to carry insurances for their own protection, because it imposes restrictions upon the ability to sue the responsible driver. Drivers will receive coverage regardless if they are responsible for the damages or not under the pure no-fault state.

The ‘add-on’ no-fault state. This allows the injured victim to make a claim under the responsible driver's bodily injury liability coverage, only if his medical expenses exceeds the PIP coverage limit.

The doctrine of comparative negligence. In this state, responsibility of an accident gets distributed amongst the parties involved in it. This restricts one driver to hold the other party fully responsible for the accident and the damages caused to him.

The issue of liability. All the states require the drivers to carry at least the minimum liability coverage to protect everyone else in the neighborhood or community. This state law ensure that the driver has adequate coverage to pay for the damages he inflicted to others.
